Terms of service

Last updated October 28, 2026

Draft. This page is waiting for legal review. Text in square brackets will be filled in before it's final.

These terms are an agreement between you and the provider of Faxies named in Who we are below ("Faxies", "we", "us"). By creating an account or sending a fax with Faxies, you agree to them. The Privacy policy explains how we handle your data.

Who we are

  • Provider: Jorge Gustavo Polin Barrionuevo, trading as Faxies
  • Tax ID (NIF): 55434019V
  • Address: Avenida de la Música 2, piso 1, puerta 1, 46960 Aldaia (Valencia), Spain
  • Email: support@faxies.com

The service

Faxies sends faxes to US and Canada numbers from documents you upload or email to us. With a plan, you also get Your fax number to receive faxes. We deliver faxes over the telephone network through a fax provider. Delivery depends on the receiving fax machine and the line; most faxes arrive in a few minutes, but we can't guarantee a delivery time.

Your account

  • You must be at least 18 and able to make a binding contract. If you use Faxies for a company, you confirm you can accept these terms on its behalf.
  • You sign in with Google or with your email and a password. Keep your password and your email inbox secure: anyone who can open them can use your account.
  • You can also send a single fax without signing in. We then create an account for the email you give us, with no password, and email you a private link to that fax and its receipt. To use the account, set a password with “Forgot your password?” or sign in with Google using that email.
  • Use an email address you control, and keep your details accurate, including the name or company we print at the top of every page you send.
  • You're responsible for what is sent from your account, including faxes sent by email from the addresses you add.
  • If you think someone else used your account, write to support@faxies.com right away.

What you can't send

You agree not to use Faxies to:

  • Send unsolicited advertisements by fax. The Telephone Consumer Protection Act and the Junk Fax Prevention Act (47 U.S.C. § 227) prohibit them, and we'll close accounts that send them.
  • Send the same fax to many recipients (broadcast faxing). Each fax goes to one number.
  • Send documents you don't have the right to send, or content that is illegal, threatening or harassing.
  • Hide who you are. Every page we send carries a header with the date, time, sender and sending number, as federal law requires. Keep your name and cover page details accurate.
  • Get around our limits or a block, for example by creating more accounts.
  • Attack, overload or interfere with the service, or try to reach data that isn't yours.

We may refuse to send to a number, limit how much you send, or block an account that breaks these terms. A blocked account can still sign in to see its faxes and invoices and to cancel a plan.

Prices and payment

  • Current prices are on the Pricing page, in US dollars. You see the exact price of a fax before you pay. [TAX: whether prices include taxes]
  • Single fax: we place a hold on your card for the price shown and charge it only if the fax is delivered. If it fails, we release the hold.
  • If the line is busy or doesn't answer, we try again up to 2 more times at no extra charge.
  • There is no setup fee.

Payments are processed by Stripe. We never see your full card number.

Plans, renewal and canceling

  • Plans renew automatically at the end of each month or year, and we charge the card on file until you cancel. You agree to this separately on the payment page, next to the button that pays.
  • We email you a confirmation with the price, the renewal date and how to cancel. We also email you a reminder before each renewal of an annual plan, and once a year before a monthly plan renews.
  • Each month of a plan includes a number of pages; unused pages don't carry over. Pages of a failed fax come back to your balance.
  • You can cancel a plan in one click in Billing, at any time. It stays active, with its pages and Your fax number, until the end of the period you paid for.

Refunds

  • A single fax that fails costs nothing: we release the hold on your card.
  • A delivered fax isn't refundable, and we don't refund the rest of a period when you cancel a plan.
  • If a plan renewed and you didn't mean to keep it, write to support@faxies.com within 7 days of a monthly renewal or 30 days of an annual renewal. If you haven't sent a fax with the plan since it renewed, we refund that renewal in full and end the plan right away.
  • If we charged you by mistake, for example twice or after you canceled, we refund it.
  • Refunds go back to the card you paid with. Your bank may take 5 to 10 business days to show them.
  • If you're a consumer in the European Union or the United Kingdom, you can also withdraw from a plan within 14 days of buying it, without giving a reason, by writing to support@faxies.com. We refund that first payment in full within 14 days. Renewals follow the rules above.

Please write to us before disputing a charge with your bank. While a dispute is open, we may pause the account.

Your fax number

Your fax number is included in a plan and stays yours while the plan is active. When a plan ends, we tell you the date we'll release the number; after that date it may go to someone else. You can ask to move a number you already have to Faxies; moving it depends on your current carrier.

Your documents

You keep all rights to your documents. You let us store and transmit them only to provide the service. We delete the documents of each fax, sent or received, 30 days after it finishes, so keep your own copy. See the Privacy policy for details.

Faxies doesn't offer HIPAA compliance, and we don't sign business associate agreements (BAAs). Don't use it to send protected health information on behalf of a HIPAA-covered entity.

What we don't promise

We work to deliver every fax, but delivery depends on things we don't control: the telephone network, the receiving machine and its line, and our providers. So, as far as the law allows:

  • Faxies is provided "as is" and "as available".
  • We don't promise that every fax will arrive, arrive by a certain time or print perfectly, or that the service will never be interrupted.
  • The status we show is what the network reports. "Delivered" means the receiving machine accepted the pages, not that someone read them.
  • We give no other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

This doesn't take away rights that consumer law gives you and that can't be waived.

Limits of our liability

As far as the law allows:

  • We aren't liable for indirect or consequential losses, such as lost profits, revenue, business or data, or a missed deadline because a fax arrived late or didn't arrive.
  • Our total liability for all claims about Faxies is limited to the greater of what you paid us in the 12 months before the claim and US$100.

These limits don't apply to losses caused by our fraud, intentional misconduct or gross negligence, to death or personal injury caused by our negligence, or to anything else the law doesn't allow us to limit.

Your responsibility for what you send

You'll cover our losses and reasonable legal costs from claims by others that arise from the documents you send, from faxes sent from your account that break the Telephone Consumer Protection Act, the Junk Fax Prevention Act or other fax or telemarketing laws, or from your breach of these terms or of someone else's rights. We'll tell you about the claim promptly and let you take part in the defense. If you're a consumer, this applies only as far as the law where you live allows.

Suspending or closing an account

  • We can suspend or close an account right away if it sends junk faxes or illegal content, doesn't pay, disputes charges it made, gets around our limits, or puts the service or other people at risk.
  • For any other reason, we'll email you 30 days before and refund the unused part of any period you paid for.
  • You can close your account at any time: cancel your plan in Billing, then write to support@faxies.com from your account's email.
  • When an account closes, we release Your fax number, delete documents as usual and delete the fax history 30 days later. We keep invoices as long as tax law requires, and the record of your agreement to automatic renewal as long as California law requires.

The sections on liability, your responsibility and disputes still apply after an account closes.

Changes to these terms and prices

  • If a change to these terms matters to you, we'll email you at least 30 days before it applies. Changes the law requires, or that only fix mistakes or add features, may apply sooner.
  • If we change the price of your plan, we'll email you 7 to 30 days before the first renewal at the new price, with how to cancel.
  • If you don't agree, cancel before the change applies. If you cancel an annual plan because of a change, we refund the full months you haven't used.

The date at the top shows the last update. Earlier versions are available on request.

How the contract is made

You agree to these terms when you create an account or send your first fax. Before you pay, you see the recipient, the pages and the exact price, and you can go back and change anything. After you pay, the page confirms it and the fax appears in your dashboard with its price; plan invoices are in Billing. The contract is in English.

Governing law and disputes

  • If something goes wrong, write to support@faxies.com first. Most problems are solved that way, and we'll answer within 30 days.
  • These terms are governed by the laws of Spain, and disputes go to the courts of Valencia, Spain.
  • If you're a consumer, you keep the protections that the law where you live gives you and that can't be waived, including the right to bring a claim in your local courts, small-claims court included.

Other terms

  • These terms, the Privacy policy and the prices you accept are the whole agreement between you and us about Faxies.
  • If a court finds part of these terms invalid, the rest still applies.
  • We may transfer this agreement to a company we control or that takes over Faxies; we'll tell you by email. You can't transfer your account without our agreement.
  • If we don't enforce a term right away, we can still enforce it later.
